Home invasion suspects waive hearings

Three of the four men arrested in connection with the alleged home invasion in Baisden July 12 appeared in Magistrate Court before Magistrate Eugene Crum last week.

Each of the three defendants waived their rights to a preliminary trial.

Willie Wayne McCoy, 31, of Detroit Mich, waived his right to a preliminary hearing. McCoy represented by Attorney Ron Rumora, is being charged with burglary, first-degree robbery, grand larceny, malicious wounding, first degree sexual assault, kidnapping, and conspiracy for each individual charge.

Chester Shirley Lester, 20, of Baisden, and Joshua Cantrell, 19 of Wharne-cliffe, also waived their rights to a preliminary hearing.

Lester, represented by Attorney Diana Carter Wiedel and Cantrell, represented by Attorney Kathy Sturgill are being charged with first-degree burglary, grand larceny, sexual assault, malicious assault, kidnapping, and conspiracy for each individual charge.

Casey James Behalar II, 28 of Gilbert, asked for a continuance of his preliminary hearing due to not having legal counsel. Behalar was denied a court appointed attorney because of excess of income. Magistrate Crum issued a continuance of Behalar’s preliminary hearing to allow Behalar time to find legal counsel. The preliminary hearing has been rescheduled for Sept. 1 at 9 a.m. in Mingo Magistrate Court.

The four men were arrested July 13 for an alleged home invasion of Terry Bowles’ residence in Baisden the previous night. Police stated that McCoy and Cantrell entered the home, threatened Bowles and an unidentified woman. with a semi-automatic pistol found at the residence. During the course of the incident, authorities allege the men assaulted Bowles’ and another party, Jimmy Keith West, with a tire iron.

McCoy is alleged to have sexually assaulted the unidentified female while Cantrell subdued Bowles and West.

Police said Behalar and Lester assisted as the look-out and driver for McCoy and Cantrell while they were inside the residence.

Police claim the four men also took $2,500 in currency and Oxycontin from the residence on the night of the alleged invasion.
